Recently, the Changsha County People's Court made a judgment that the defendants Zeng XX, Liu XX, Min XX and Zhao XX infringed on the trademark rights and other legitimate rights and interests of Sany Group, and committed the crime of counterfeiting registered trademarks, and were sentenced to fixed-term imprisonment ranging from 2 years and 9 months to 10 months.

In February 2021, after being reported by the masses, the Market Supervision Bureau of Kaifu District, Changsha City, seized a large number of counterfeit Sany Towers in a factory in Zhu'an Village, Shaping StreetcraneStandard sections and outriggers.

It was found that this batch of counterfeit products was illegally produced by Zeng Moumou through his company. From 2020 to the time of seizure, the parties involved in the case have produced and sold more than 100 sets of counterfeit Sany tower crane standard sections and outriggers without the permission of Sany Group, with a total value of more than 750,000 yuan.

However, during the period when Zeng Moumou was released on bail pending trial, he teamed up with Liu, Min, Zhao and others to repeat their old tricks and continue to illegally produce counterfeit Sany tower crane standard sections through another company under his name, and his arrogance was very arrogant.

In January 2022, after monitoring and reporting by Sany Group, the Kaifu District Public Security Police seized a total of 20 sets of counterfeit Sany products in the company under the name of Zeng. Subsequently, Zeng Moumou and four others were approved for arrest.

Four were sentenced to prison terms

In 2022, the Changsha County Procuratorate prosecuted four defendants, including Zeng Moumou, for the crime of counterfeiting registered trademarks to the Changsha County People's Court.

The court held that the defendants Zeng, Liu, Min and Zhao had relied on their companies to produce goods with counterfeit registered trademarks without the permission of the owner of the registered trademark, with a total illegal business turnover of more than 1.17 million yuan, of which more than 190,000 yuan had been sold, the evidence was conclusive, the circumstances were particularly serious, and their acts constituted the crime of counterfeiting registered trademarks.

In accordance with the provisions of Articles 213, 25, 26, 67, 72 and 64 of the Criminal Law of the People's Republic of China, the defendant Zeng XX was found guilty of counterfeiting registered trademarks and sentenced to two years and nine months imprisonment and a fine of 300,000 yuan; Defendants Liu, Min and Zhao committed the crime of counterfeiting registered trademarks and were sentenced to fixed-term imprisonment ranging from one year and two months to ten months and a fine.

In 2022 alone, the Changsha public security organs seized a total of three criminal cases such as counterfeit Trinity standard sections, lubricating oil, and piston rings, and 8 people were arrested and prosecuted by the procuratorate, and finally sentenced to fixed-term imprisonment.
