On the eve of the 23rd World Intellectual Property Day, the final judgment of the Supreme People's Court and the Hunan Provincial High People's Court finally settled the Sany patent series rights protection case with a compensation amount of more than 8.4 million yuan.

In the same year, Sany Automobile entrusted Hunan Huaxia Fangyuan Law Firm to collect evidence on the infringement of Jiuhe Company, and immediately filed five patent lawsuits with the Changsha Intermediate People's Court, including two invention patents, two utility model patents and one design patent.

After the trial, the Changsha Intermediate People's Court made a first-instance judgment, finding that Jiuhe's infringement was established, and ordered it to immediately stop manufacturing, selling, and promising to sell the infringing products, and compensate Sany Automobile for economic losses and reasonable rights protection costs of nearly 10 million yuan.

2In August 020, Jiuhe Company was dissatisfied with the first-instance judgment and appealed to the Supreme People's Court and the Hunan High Court respectively. After the final trial by the Supreme People's Court and the Hunan High Court, by April 2023, except for one of the cases, which revoked the first-instance judgment due to a dispute over technical characteristics, the original judgment was upheld in the remaining four cases, that is, Jiuhe Company was required to compensate Sany Automobile for economic losses and reasonable rights protection costs of more than 8.4 million yuan. So far, Sany Automobile's four-year road of rights protection has come to a successful end.

The award amount of more than 8.4 million yuan has also created the largest patent infringement case in the construction machinery industry in recent years, and has received widespread attention.

Industry insiders believe that the ultra-high amount of damages and the defendant's multiple rounds of patent invalidation have proved from the side that the patent involved in the case has strong stability, a high degree of technological innovation and high economic value, and a good interpretation of what a high-value patent is.

Industry insiders also believe that the victory of Sany Automobile demonstrates Sany's determination to protect intellectual property rights, sets an example for the industry, and will become a classic case of intellectual property protection in the entire construction machinery industry, which is of far-reaching significance.
